These Terms & Conditions govern the use of the GrowtheraKart platform and the role, responsibilities, and limitations of Independent Distributors associated with Nextera World (OPC) Private Limited. By registering on the platform, every Distributor agrees to comply fully with these terms, the Consumer Protection (Direct Selling) Rules, 2021, and applicable laws of India.

1. Eligibility and Registration

1.1 Only individuals 18 years or older with valid KYC documents are eligible to register.
1.2 GrowtheraKart does not charge any joining, registration, or enrollment fee.
1.3 The company reserves the right to accept, reject, or cancel any application at its sole discretion, without providing any reason.

2. Role of Independent Distributor

2.1 All Distributors operate as independent contractors, and not as employees, agents, representatives, or partners of the company.
2.2 Distributors must present the business plan accurately and truthfully, based solely on company-approved materials.
2.3 Distributors are strictly prohibited from offering or implying:
  • Jobs or employment
  • Fixed salary or stipends
  • Guaranteed income or financial assurances
2.4 Earnings depend entirely on actual product sales, personal effort, and team performance. No income is assured.

3. Prohibited Conduct

Distributors must not:
  • Provide misleading, false, exaggerated, or unverified claims.
  • Force or pressure anyone to purchase a product or join the business.
  • Sell products below MRP or on unauthorized e-commerce or social platforms.
  • Operate multiple accounts or use fake, borrowed, or manipulated identities.
  • Share or disclose confidential company information, training materials, or internal documents.
  • Any violation will lead to disciplinary action.

4. Data & Login Security

4.1 Distributors are responsible for protecting their login credentials.
4.2 All actions carried out through a Distributor’s ID—whether by the Distributor or a third party—will be considered the Distributor’s responsibility.
4.3 The company is not liable for any misuse arising from compromised login information.

5. Termination Rules

5.1 The company may terminate a Distributor’s ID for violations of company policies, unethical conduct, fraud, misrepresentation, or breach of laws.
5.2 Upon termination:
  • All benefits, incentives, and recognition immediately cease.
  • No further claims shall be entertained.
5.3 The company’s decision regarding termination is final and binding.

6. Conflict of Interest / Competition Clause

6.1 Distributors cannot promote, market, or sell products of any competing direct-selling or e-commerce entity.
6.2 Distributors cannot divert customers or prospects away from GrowtheraKart for personal or competitive benefit.

7. Dispute Resolution

7.1 All complaints must be submitted within 30 days of the issue to be considered valid.
7.2 Any unresolved dispute shall fall under the exclusive jurisdiction of the company’s administrative authority.
7.3 Legal jurisdiction, if required, will apply based on the company's registered office location.

8. Professional Behaviour Policy

Distributors must:
  • Maintain respectful, polite, and professional behaviour at all times.
  • Avoid negative statements, insults, offensive conduct, or defamation—online or offline.
  • Uphold and protect the positive brand image of GrowtheraKart.

9. Ethical Business Conduct

Distributors must:
  • Share accurate, truthful, and company-approved information only.
  • Avoid exaggeration of product benefits, false claims, or misrepresentations.
  • Never mislead, misinform, or manipulate customers or team members.

10. Income Claim Policy

10.1 Distributors must not promise or imply:
  • Salary
  • Fixed monthly income
  • Guaranteed earnings
10.2 Only company-approved presentations explaining the income structure may be used.
10.3 Fake income screenshots, edited proofs, or manipulated earnings claims are strictly prohibited and treated as fraud.

11. Team Responsibility & Leadership Conduct

11.1 Upline leaders must offer guidance, training, and moral support to their downline teams.
11.2 No Distributor shall pressure, manipulate, or mentally exploit team members.
11.3 Leaders must maintain a transparent, ethical, and supportive working environment.

12. Social Media Policy

12.1 Promotions must be honest, legal, and aligned with company guidelines.
12.2 Fake income posts, manipulated content, or misleading promotional material are prohibited.
12.3 Distributors must ensure that all social media content maintains the company’s reputation and follows brand standards.

13. Confidentiality Policy

13.1 All company data, training materials, business strategies, documents, and internal communications are confidential.
13.2 Unauthorized sharing, duplicating, or distributing such information is a violation and may result in termination and legal action.

14. Disciplinary Actions

Depending on the severity of the violation, the company may impose one or more of the following actions:
  • Official Warning
  • Temporary Suspension of Distributor ID
  • Permanent Termination
  • Legal Action under applicable laws
The company maintains the right to take immediate action where necessary to protect its interests.
